    • Medical Screening Examination (MSE): EMTALA requires that all individuals who come to the emergency department seeking medical attention must receive an appropriate medical screening examination. The MSE must be performed by a qualified medical professional to determine if an emergency medical condition exists.

    • Treatment Stabilization: If the MSE reveals that the patient has an emergency medical condition, the hospital is obligated to provide stabilizing treatment regardless of the patient's ability to pay or insurance status. The hospital is required to provide treatment until the patient's condition is stabilized, or until the patient can be safely transferred to another facility.

    • Transfer Restrictions: EMTALA imposes restrictions on transferring unstable patients to another hospital. A hospital can transfer an unstable patient to another facility only if the receiving hospital has the capacity and capability to treat the patient's condition. Additionally, the transfer must be medically appropriate and done in accordance with the law's requirements.
